Maine New Hire Reporting: 7-Day Deadline, Contractors and How to File (2026)

Maine gives employers 7 days from the date a new or rehired employee first performs paid work to report them (19-A M.R.S. § 2154). Report through the Maine New Hire Reporting Portal at ME-Newhire.com, or by fax or mail. Independent contractors must be reported when payments are expected to reach $2,500. An employer who knowingly fails to report gets a written warning first, then a civil penalty of up to $200 per month for later violations.

What a Maine report contains

§ 2154(4) spells out the content. For the employee: name, address, Social Security number, date of birth, and the most recent date that services for remuneration were first performed. For the employer: name, address and employment security reference number or unified business identifier number. The portal's form fields are organized around the FEIN instead.

Note the mismatch: the portal marks date of birth optional, but the statute lists it among the required contents of the report, and the federal contact guide lists it as a Maine data element. Include it. The portal also asks you to use the same FEIN you use on quarterly wage reports.

Filing through the Maine New Hire Reporting Portal

Maine moved new hire reporting to a redesigned portal. The old portal.maine.gov/newhire address now points employers to ME-Newhire.com, and the contact details changed with it.

  • Online: register with your FEIN and an email address, then report hires with a printable confirmation, 24 hours a day.
  • File transfer: upload payroll exports through the site or by FTP, using the portal's electronic reporting specifications. The FAQ says employers reporting more than 25 new hires must use one of the electronic options.
  • Fax: toll-free (888) 334-3760.
  • Mail: Maine New Hire Reporting Center, P.O. Box 463, Norwell, MA 02061.
  • Paper: the Maine New Hire Reporting Form, a W-4 with employer name, FEIN and address written at the bottom, or a payroll printout in at least 10-point type.

Seven days from the first paid shift

The statute ties the clock to work, not paperwork: an employer shall submit a report within 7 days of the date that services for remuneration are first performed by a newly hired employee. The portal adds that electronic filers may send two monthly transmissions, if necessary, no less than 12 and no more than 16 days apart.

A week is shorter than most payroll cycles. A Portland hotel that starts a housekeeper on a Monday has until the following Monday, which means the report usually cannot wait for the next biweekly payroll run. A practical fix is to report at the end of orientation, or to have the payroll provider transmit on its own schedule, since Maine accepts reports from payroll services. When a start date slips because of a background check, the 7 days slide too, as long as the recorded start date is updated.

Independent contractors: the $2,500 rule

§ 2154(4-B) requires employers to report contracting for services in Maine with an independent contractor when payment is anticipated to equal or exceed $2,500. The deadline is also 7 days, counted from the earlier of first making payments that total $2,500 or more in a year, or signing a contract (or contracts) providing for that much. The contractor report is longer than an employee report:

  • The contractor's name, address and Social Security number.
  • The employer's name, business name, address and telephone number, and its Social Security number, employment security reference number or unified business identifier number.
  • The date the contract was signed or, with no contract, the date payments first reached $2,500.
  • The total dollar amount of the contract, if any, and its expiration date.

A copy of the 1099-MISC form may be used. Direct sellers, as defined in federal tax law, are excluded.

Penalties: statute versus portal

The two sources disagree, so here is each in its own words. § 2154(6): an employer who knowingly fails to report must be given a written warning for the first violation and is subject to a civil penalty of up to $200 per month for each subsequent violation after the warning; all violations within a single month count as one. The portal's Compliance & Penalties page and FAQ say instead that Maine employers may be fined up to $50 per day per newly hired employee, and up to $500 in a conspiracy case. The statute is the law, and it is the figure we rely on here.

Rehires and returning seasonal staff

Maine publishes a threshold. The statute defines a newly hired employee as someone never employed by you before, or someone previously employed who has been separated for at least 60 consecutive days. The portal's FAQ adds a second trigger: report a returning employee if they are required to complete a new W-4. For summer camps, coastal restaurants and harvest crews, most returning seasonal staff will meet one test or the other.
